General Terms and Conditions of Charter

1. Parties and Scope

Angelina Tours d.o.o. (hereinafter referred to as AT), in accordance with these General Terms and Conditions and the Charter Contract, shall rent the charter vessel to the person confirming the reservation or making the advance payment (hereinafter referred to as the Client) for the agreed charter period.

AT guarantees that all charter vessels are seaworthy, properly maintained, clean, and that their machinery and equipment are in proper working order at the time of delivery.

By confirming a reservation or making an advance payment, the Client enters into a legal relationship with AT and accepts these General Terms and Conditions. These Terms and Conditions constitute a legally binding agreement for both parties and form the basis for resolving any dispute between the Client and AT.

2. Prices and Terms of Payment

2.1 Charter Price

Charter prices are stated in Euros (EUR) according to the current AT Price List and include VAT at the rate of 13%. AT reserves the right to amend the Price List without prior notice.

The Charter Fee includes:

  • A technically sound and clean vessel with a full fuel tank upon delivery
  • On-board accommodation and use of vessel equipment
  • Compulsory third-party and comprehensive insurance
  • Accident insurance for the crew
  • Mooring at the base marina
  • Cruising Permit for navigation in the Republic of Croatia
  • Internet connection (where available)

The Charter Fee does not include:

  • Fuel consumption during the charter period
  • Mooring and port fees outside the base marina
  • Additional services and consumables at AT bases
  • Car parking fees
  • Health insurance for the crew

2.2 Skipper and Hostess

If the Client requests a skipper and/or hostess from Angelina Tours d.o.o., this must be specified at the time of booking confirmation. The cost must be fully paid together with the balance payment or directly to the skipper/hostess at check-in on the first day of the charter.

2.3 Documentation Requirements

Copies of a valid navigation license and VHF certificate must be submitted at the time of booking. The crew list must be provided no later than one (1) week before the commencement of the charter. Clients arriving by air are encouraged to provide their arrival time and flight number at least one (1) week in advance.

2.4 Payment Deadlines

The Client must make an advance payment within seven (7) days of reservation confirmation. The remaining balance must be paid no later than forty-five (45) days before the start of the charter period.

AT offers the following payment models:

Model 1

  • 25% within seven (7) days of reservation confirmation
  • 25% within forty-five (45) days from reservation confirmation
  • 50% no later than forty-five (45) days before the start of the charter

Model 2

  • 100% payment within seven (7) days of reservation confirmation

Discounts under Model 2:

  • 1% for reservations confirmed within three (3) months before the charter start
  • 2% for reservations confirmed between three (3) and six (6) months before the charter start
  • 5% for reservations confirmed six (6) months or more before the charter start

For reservations confirmed within twenty (20) days before the charter start, payment is due within 48 hours. For reservations confirmed within ten (10) days before the charter start, payment is due within 24 hours.

The vessel may only be taken over once all payments due to AT have been made in full.

3. Changes to or Cancellation of Reservation

Any change or cancellation must be submitted in writing via email to storno@angelina.hr.

3.1 Free Cancellation

  • For charters beginning in March, April, or May: free cancellation up to three (3) months before the charter start
  • For charters beginning in June, July, August, September, October, or November: free cancellation up to six (6) months before the charter start

In cases of free cancellation, AT reserves the right not to accept a new booking from the same Client for the same vessel or vessel model during the same period.

3.2 Cancellation Fees

All cancellations outside the free cancellation periods, as well as cancellations due to late payment, result in a cancellation fee equal to the total amount paid. All paid amounts shall be retained by AT.

4. Boarding (Check-in)

Vessel delivery takes place on Saturdays from 5:00 PM.

At check-in, the Client shall:

  • Inspect the vessel, including the underwater parts
  • Sign the check-in list confirming that the vessel and equipment are in proper condition
  • Confirm familiarity with the house rules available online and on board

The Client must present:

  • The original boarding pass/voucher
  • The original navigation license and VHF certificate

The Client must submit any complaints regarding the condition of the vessel or its equipment in writing before taking over the vessel. AT will not accept liability for any claim or price reduction arising from hidden defects and deficiencies of the vessel and/or equipment at the time of embarkation, regular maintenance of the vessel, or for deficiencies and failures that may occur after boarding that could not have been foreseen or prevented by AT.

4.1 Security Deposit

A refundable security deposit must be paid at check-in to cover damages or losses not covered by insurance. The deposit may be paid in cash or by credit card (pre-authorization).

The deposit shall be refunded in full after check-out once AT confirms:

  • Timely return of the vessel at the agreed location
  • Cleanliness and proper condition of the vessel
  • A full fuel tank
  • No damages or third-party claims

If insured damage exceeds the deposit amount, AT will retain the full deposit and issue an invoice for the remaining costs.

Failure to take over the vessel within 24 hours of the agreed time and place, without prior notice, entitles AT to terminate the contract without compensation to the Client.

AT’s liability is limited to the amount of the agreed Charter Fee.

5. Return of the Vessel (Check-out)

The Client must return the vessel to the agreed destination port no later than 6:00 PM on the evening before the last charter day and vacate the vessel by 8:30 AM on the final day.

The Client is obliged to:

  • Dispose of waste in designated marina facilities
  • Leave the vessel clean and tidy

Delays not caused by technical defects may result in penalty charges and liability for consequential damages. Adverse weather conditions do not justify late return.

Returning the vessel to a port other than the agreed destination incurs transfer costs, penalties, and liability for damages not covered by insurance.

6. Client Obligations and Conduct

The Client agrees to:

  • Submit a complete crew list at least two (2) weeks before the charter start
  • Possess valid travel and navigation documents
  • Navigate safely and responsibly, avoiding dangerous areas
  • Sail only within Croatian territorial waters unless permitted in writing
  • Comply with weather conditions, maritime laws, and port authority instructions
  • Ensure only listed crew members are on board
  • Avoid regattas, towing, and illegal activities without written permission
  • Accept responsibility for the actions of all persons on board
  • Never sail under the influence of alcohol or narcotics, and handle all gear and equipment with due care and attention

Pets are permitted only with prior approval and additional charges.

7. Skipper’s Authority

The skipper must possess valid licenses and sufficient competence. AT reserves the right to request a skills demonstration. If competence is insufficient, an official skipper will be appointed at the Client’s expense.

Refusal to accept the appointed skipper results in termination of the contract without refund.

8. Insurance

The vessel is insured for third-party liability and comprehensive damage. Insurance covers damage exceeding the security deposit, excluding intentional damage or negligence.

Not insured:

  • Sails
  • Inflatable boats and outboard engines
  • Personal belongings

The Client is liable for uninsured damages and losses up to the full amount.

9. Damages During the Charter

The Client must notify AT and AT’s base immediately of any breakdown or failure of the vessel or its equipment caused by normal wear and tear. AT is obliged to repair the defect within 24 hours of receiving the notification. If AT repairs the defect within that deadline, the Client has no right to compensation. Emergency telephone numbers for defect notification can be found in the vessel documentation.

Repairs may only be carried out with AT’s approval. Unauthorized repairs will be charged to the Client.

AT bears responsibility for damage due to normal wear and tear.

A clogged toilet at check-out is charged extra and is not covered by the security deposit.

10. Complaints

Complaints must be submitted in writing at check-out and signed by both parties. Complaints submitted later will not be considered.

AT will respond within fourteen (14) days, with a possible extension of an additional fourteen (14) days. Compensation, if granted, is limited to the affected portion of the service.

11. Legal Terms

Croatian law applies. Any unresolved disputes shall be submitted to the competent court in Zadar or Split.
